The petition will be available for signing until the park closure time
is changed to open twenty-four seven. Makena State Park is for the people
to use and not to be excluded from. The 1977 proposed state park plan recognized
camping, fishing, and nature observing as twenty-four seven actvities.
PETITION TO OPEN MAKENA STATE PARK 24/7
Currently (August 15, 2006) the posted hours for Makena State Park are
5 AM to 7:45 PM. This is not consistent with the Makena-La Perouse State
Park Plan prepared for the State of Hawaii, Department of Land and Natural
Resources, Division of State Parks by H. Mogi-Planning & Research,
Inc. in 1977.
“The proposed basic design philosophy of the Maken-La Perouse state
park is to create recreational access to the area while not disturbing
or detracting from the inherent value of its natural condition and historic
resources. One goal of the park is to encourage users to recall those precious
things which may have been forgotten; clean, clear waters of the ocean,
the cooling breezes off the beach; pure, unspoiled white sand and nature
flowers and animals. Itis also a goal to introduce new experiences such
as nature observation and historic sites interpretation programs.” page

“The goals of the park design are summarized as follows:
1) Preserve the ecological balance of a valuable
natural area of the eastern Maui coast.
2) Preserve and protect for future reference
to the Hawaiian heritage, significant historic and archaeological sites
both those discovered and as yet undiscovered sites.
3) Promote preservation of a local “Hawaiian
Way of Life” i.e. fishing and opihi picking in rugged areas both for recreation

It has also been stated “We are just responding to what has become a
public safety issue,” said Randy Awo, Maui branch chief of state Division
of Conservation and Resource Enforcement. His officers have expressed concerns
over months that there have been a large number of people gathering at
the park on certain nights, with periodic reports of assaults, thefts and
robberies, and allegations of drinking and drug use. Alcohol use is banned
in all state parks.

The fact is that the number one safety hazard at Makena State Park is the ocean shore break. The 2005 Hawaii State legislature approved having life guards at Makena State Park. By acknowledging and not responding to this hazard the state has become liable for the injuries incurred just as they did for the incident at Sacred Falls on Oahu.
To arbitrarily close the park at times which only interfere with traditional activities such as night fishing, walking the beach in the stars, established Sunday drum circles is contrary to a number of constitutional rights.
